Living abroad: which address matters in a Turkish civil case?

A party’s address, a lawyer’s office address and everyday contact details have different functions in a Turkish civil case. This distinction helps people living abroad understand the file. Giving a telephone number does not itself resolve the address question.

These explanations provide general information and do not replace an assessment of individual circumstances.

Address details in a claim

Article 119 of the Turkish Code of Civil Procedure includes the addresses of the parties and, where applicable, the representative among the details of a claim. Living abroad does not mean that any Turkish address can automatically replace the party’s address.

Service of documents and everyday communication

Service rules contain separate provisions on the known address and matters handled through a representative. Email or messaging-app correspondence should not simply be equated with formal service. The recipient and method require consideration of the particular step and proceedings.

Short questions

How can the foreign address be recorded clearly?

Record the country, city, postal code and other address components consistently. Distinguish earlier addresses from the current one. Differences from the court file should be clarified rather than left unexplained.

Does an address determine the competent court?

Address details, jurisdiction and the method of service are separate questions. Stating an address does not alone determine which court has jurisdiction or whether service was valid.
