Is a company name the same as a trademark?

A company name, domain and brand used on products may look identical but raise different questions. Business identity and protection of signs for goods or services should be considered together.

Does company formation replace a trademark assessment?

Company formation and a trademark application are different processes. Using a name as a company name does not by itself establish that it can be used as a trademark for every product or service.

Do only identical names matter?

A search should not be limited to exactly matching words. Similarity and the goods or services concerned may matter. Finding no matching name online is not by itself assurance.

What information helps initially?

The proposed name or logo, goods and services, available application details and examples of use can help. Where a dispute exists, dates of relevant correspondence also matter.
